Seasons Art Class Hawke’s Bay – Terms & Conditions
1. Fee Policies & Procedures
1.1 Fees are strictly payable before the first class of the course. Payment must be made by deposit into the Franchisee’s account or by online payment once a deposit has been paid, unless prior payment arrangements have been agreed.
1.2 Failure to pay fees may result in loss of the enrolment position.
1.3 If, by prior arrangement, a student attends the first art class without having made full payment, fees will be due within seven days. From the eighth day, unpaid accounts will incur a $20 late-payment fee.
1.4 Where classes fall on public holidays, make-up classes will be added to the end of the term.
2. Refund Policies & Procedures
2.1 For all courses, no refunds will be given within seven days of the commencement date unless a replacement enrolment can be secured from a waiting list.
If you cancel more than seven days before the start date, you are entitled to a refund.
All cancellations will incur a $40 administration fee per student booking, and any credit-card or online-processing fees are non-refundable, as they are charged by third-party payment providers.
2.2 Within 14 days of commencement: Any refund granted at the Franchise Owner’s discretion will incur a $20 administration fee, in addition to any credit-card or transaction charges.
2.3 Transfers: Fees cannot normally be transferred to future terms unless agreed by the Franchisee.
2.4 Postponement: Where a class is postponed due to circumstances beyond our control (for example, tutor illness, venue issues, or emergencies), no refund will be offered. Classes will continue at a suitable date once circumstances allow.
2.5 Make-Up Sessions:
If you advise us at least seven days in advance of missing a class, and a spot is available in another class during the same week at the same location, we may offer an optional make-up session.
This is not always possible when classes are full, but we will do our best as a goodwill gesture. In some cases, a make-up may be offered in the following term.
Seasons Art Class will not be held responsible if make-ups cannot be scheduled or if classes cease to operate.
2.6 Sickness or Personal Circumstances:
If you miss one or more sessions due to illness, holidays, or personal reasons, the full term fee remains payable as your space is reserved.
In cases of serious illness or injury preventing participation in the entire term, your enrolment may be transferred to a future course at the Franchise Owner’s discretion.
2.7 Communication:
All cancellation or refund requests must be made in writing. You will receive written confirmation once your request has been processed.
If you do not hear from us within 48 hours, please check your spam folder or contact us directly to confirm receipt.
2.8 If Classes Cease to Operate:
If Seasons Art Class Hawke’s Bay ceases to operate or cannot deliver a scheduled course, any deposits or payments for classes that have not yet commenced will be refunded in full, less any applicable credit-card or transaction fees.
3. Class Uniform Policies & Procedures
3.1 Students may wear any comfortable clothing to class. Aprons are provided.
Seasons Art Class is not responsible for any damage to students’ personal clothing or belongings.
4. Health, Safety, Injury & Medical Conditions

Seasons Art Class will provide a safe learning environment to minimise risk, but is not liable for personal injury or for lost, damaged, or forgotten property.

Qualified tutors always promote safe art practices.

Students must advise the Tutor/Host of any illness, injury, or medical condition prior to class, especially if it may affect participation.

A first-aid kit is available. Tutors do not administer medication or provide pain relief (e.g. Panadol).
5. Safety & Security Policies
5.1 While every effort is made to provide a safe environment, Tutors and Hosts cannot be responsible for students outside allocated class times or outside the classroom.
6. Class Policies
6.1 Students should arrive punctually to ensure they receive full instruction.
6.2 Regular attendance supports artistic development.
6.3 A minimum of 12 students is required to run a class.
6.4 Seasons Art Class reserves the right to dismiss any student who behaves inappropriately, creates safety risks, damages property, or repeatedly disrupts sessions.
Dismissed students are not entitled to refunds or credits for remaining classes.
7. Photography in the Classroom
7.1 Photography within classes is permitted only by the Franchisee/Host.
7.2 By participating, students grant Seasons Art Class permission to use class or group photographs for marketing, website, social-media, or promotional purposes.
7.3 Photography of teaching materials, methods, or copyrighted content is strictly prohibited, as these remain the property of Seasons Art Class.
7.4 If you do not wish to appear in any photographs, please notify your Tutor or Host before or during the first class, and your preference will be respected.
8. Complaints
8.1 Formal complaints should be made in writing to Seasons Art Class.
An appointed person from Head Office will contact you to discuss and respond in writing, making every effort to find a fair resolution.

Student Conduct
All students enrolled at Seasons Art Class are expected to behave respectfully and professionally.
Students must:

Be considerate towards Tutors, Hosts, and fellow students.

Follow teaching instructions.

Avoid intimidating, confrontational, or harassing behaviour (including verbal, sexual, or physical harassment).

Not bring or use illegal drugs or substances on the premises.
Any breach of conduct may result in dismissal from the course without refund.
Raffle, Prize & Gifted Places
Any class places obtained through a raffle, prize draw, charity auction, or similar promotion must be redeemed with Seasons Art Class Hawke’s Bay only.
Such places are non-transferable, non-exchangeable, and cannot be redeemed for cash.
All standard Terms & Conditions apply to prize recipients.
Disclaimer
Seasons Art Class will make every effort to ensure that all courses proceed as advertised on its website or publicity material.
However, all courses are subject to minimum enrolment numbers, and we reserve the right to cancel or modify any course content, structure, or schedule as necessary—without compromising overall quality.
Compliance with New Zealand Law
These Terms & Conditions are governed by the laws of New Zealand, including the Consumer Guarantees Act 1993 and the Fair-Trading Act 1986 (as amended), which protect your rights as a consumer.
Nothing in these Terms overrides your legal rights under New Zealand law.
